Even though the defendant waited four years from the time of judgment to file a petition to vacate based on a lack of personal jurisdiction, the Second Circuit Court of Appeals held that since the plaintiff had used an uncertified private detective agency to serve the summons for the foreclosure cases at issue the trial court lacked personal jurisdiction to enter a judgment and the judgments were void. West Suburbank Bank v. Advantage Financial Partners LLC, 2014 IL App (2d) 1231146. Based on the Private Detective Act (22 ILCS 447/5-5), a summons may be served by a certified detective agency only. However, little did this help the defendant, since the properties had been sold to third-parties since the time of the auctions and the appellate court’s decision could not reverse these sales.
